These Terms of Use ("Terms") are a binding agreement between you and Silk Creative Labs LLC, a California limited liability company ("Silk Creative Labs," "we," "us," or "our"), governing your access to and use of the ClaimYourCollege website and application at claimyourcollege.com and any related subdomains, together with all content, tools, and features we make available through it (collectively, the "Service").

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Statement, which is incorporated here by reference. If you do not agree, do not use the Service.

1. Who we are and how to reach us

The Service is operated by Silk Creative Labs LLC.

If any provision of these Terms requires notice to us, send it to the contact email above unless a specific address is stated elsewhere.

2. Eligibility and who may purchase

Free features. The free features of the Service are informational and are intended to help students, families, and the adults who support them plan for college funding. A student may use the free Service.

Paid features and purchases. Only an adult (a person 18 years of age or older) or an institution acting through an authorized adult may purchase a paid plan, enter payment information, or accept a paid license. Paid plans are marketed to and sold to parents, guardians, other supporting adults, and institutions. They are not sold to minors, and minors may not make purchases. By purchasing or activating a paid plan, you represent that you are at least 18 years old and are entering the transaction on behalf of yourself or an institution you are authorized to represent.

Not directed to young children. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. See our Privacy Statement and Section 15 below.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

3. What the Service is, and what it is not

The Service helps you organize a personal college funding plan. Depending on the features you use, it can include curated information about scholarships, grants, and state aid programs; deadline tracking; a FAFSA estimator; a college cost worksheet; essay and brag sheet planning tools; and, for paid subscribers, an award letter comparator, per college supplemental essay prompts, an essay paragraph bank, and printable packets.

The Service is educational information and a planning aid only. It is not, and must not be relied on as, financial advice, investment advice, tax advice, legal advice, or admissions or professional counseling. We are not a financial advisor, lender, broker, law firm, accounting firm, school, or government agency, and using the Service does not create any advisory, fiduciary, or professional relationship between you and us.

Any estimate the Service produces (including any financial aid, cost, or FAFSA related figure) is an approximation for planning purposes only. Your actual eligibility, award, cost, and results will differ and are determined solely by the relevant schools, programs, lenders, and government agencies. Before you rely on any date, rule, amount, or eligibility statement, confirm it against the official source, which we link from the relevant item wherever practical. Final responsibility for your applications, deadlines, submissions, and decisions rests with you.

4. Accuracy of information and third-party programs

We curate program information and re-verify it on a regular schedule, and we stamp the date of the most recent verification in the application. Even so, deadlines, amounts, eligibility rules, essay prompts, and program terms change frequently, sometimes without notice, and can contain errors. We make no guarantee that any information in the Service is current, complete, or accurate at the moment you view it.

The Service references and links to third-party websites, programs, scholarships, calculators, and applications that we do not operate or control. We are not responsible for the content, availability, accuracy, policies, or practices of any third party. A reference or link is not an endorsement, and we are not responsible for any interaction or transaction between you and a third party.

Scholarship safety. Legitimate scholarships and financial aid programs do not require you to pay a fee to apply or to receive an award. Never pay to apply for a scholarship, and never share bank, payment, or Social Security information with a scholarship program that is not an official school or government source you have independently verified.

5. No accounts, and information stored on your device

The Service does not use accounts, logins, or passwords, and we do not store the information you enter into the Service on any server we control. The plan information you create (such as your profile, interests, tracked programs, notes, essays, brag sheet, cost and award worksheets, paragraph bank, and activity history) is saved only in your own web browser's local storage on the device you are using. You control that information, and you can delete it at any time by clearing it in the application or clearing your browser's site data.

Because this information lives on your device, it is your responsibility to keep your own backups (the Service provides an export and restore feature for this purpose) and to protect your device. Information stored in a browser can be lost if you clear your browser data, use private or incognito mode, switch devices or browsers, or if your device is lost or damaged. On a shared device, anyone with access to that device and browser can view information saved in it, because there is no password protection. We are not responsible for any loss of, or unauthorized access to, information stored on your device.

6. Paid plans, licenses, billing, and refunds

Some features are available only under a paid plan (for example, the "Family Plan"). The following terms apply to paid plans.

a. Pricing. Current prices are shown in the Service or at the point of purchase. The Family Plan is currently offered at $149 per school year, with a founding price of $99 per school year for waitlist members whose founding price we have confirmed. Prices, plans, and features may change; the price in effect when you purchase or renew applies to that term. Prices are in United States dollars and do not include any taxes, which, if applicable, are handled at checkout.

b. Payment processing. Silk Creative Labs LLC is the seller of the paid plans; we sell them directly rather than through a third-party merchant of record. Payments are processed by our payment processor, Stripe, Inc., under Stripe's own terms and privacy policy. Stripe collects and handles your payment card information and processes the charge; we do not receive or store your full payment card number. From Stripe we receive only the limited information needed to issue and support your license, such as confirmation that the purchase completed, your email address, and the family name and school year to place on the license. We do not currently collect sales tax.

c. What a paid plan grants. A paid plan grants the purchasing family or institution a limited, personal, non-transferable, non-exclusive license to use the paid features for the applicable term, on the devices where the license key is activated. A license is issued for a school year and expires at the end of that term (for the Family Plan, on June 30 of the applicable year unless stated otherwise). Sharing, reselling, publishing, or distributing a license key is prohibited and may result in deactivation without refund.

d. Term and renewal. Paid plans are a one-time purchase for a single school year. They do not auto-renew, there is no subscription, and no payment card is kept on file, so there is nothing to cancel. A license expires at the end of its school year (for the Family Plan, on June 30 of the applicable year), after which you may purchase a new term if you choose. Where we have confirmed a founding price for a waitlist member, we honor that price for that member's initial purchase, as described in Section 6f.

e. Refunds. We offer a 30-day, no-questions-asked full refund on a paid plan. To request one, email support@claimyourcollege.com within 30 days of purchase, from the address you bought with or including the family name on your license. The refund is returned to your original payment method through Stripe. When a refund is issued, the license key from that purchase is deactivated and stops unlocking the paid tools the next time the app loads. Our full refund policy is published at https://claimyourcollege.com/refund/. Nothing in this section limits any statutory cancellation right you may have that cannot be waived.

f. Honoring the waitlist. Where we have confirmed a founding price for a waitlist member, we will honor that price for that member's initial purchase in accordance with the offer as communicated.

7. Acceptable use

You agree that you will not, and will not permit anyone else to:

Personal use of the deployed application by students and families for their own college planning is permitted and encouraged.

8. Essay and writing tools; academic integrity

The Service's essay and writing tools are designed to coach and organize your own writing. They do not, and are intended not to, write essays or application text for you. Any writing you submit to a college, scholarship, or program must be your own work, and you are solely responsible for the integrity and accuracy of everything you submit.

If the Service offers an optional feature that hands your draft to a separate artificial intelligence tool you choose to use, that tool is operated by a third party under its own terms, and you are responsible for your use of it and for complying with the academic integrity and authorship rules of every program you apply to. Many admissions and scholarship programs prohibit or penalize machine-written submissions. We are not responsible for any consequence arising from work you submit.

9. Intellectual property

The Service, its software and source code, its user interface, and its curated program dataset (including editorial descriptions, application step sequences, eligibility summaries, and state aid pattern text) are the property of Silk Creative Labs LLC and are protected by copyright and other laws. We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Service for your own college planning and, for paid features, subject to your paid plan. No other rights are granted. You may not copy, modify, redistribute, scrape, or create derivative works from the Service or its dataset, in whole or in part, without our prior written consent, except that you may print, download, and keep copies of your own plan and the documents the Service generates for your personal, non-commercial use.

"ClaimYourCollege," the ClaimYourCollege logo, and related names and marks are common-law trademarks of Silk Creative Labs LLC. You may not use them without our prior written permission.

10. Your content and feedback

You retain ownership of the information and writing you create using the Service, which, as described above, is stored on your device rather than by us. If you send us feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or obligation to you.

11. Communications and the waitlist

If you email us or join a waitlist (for example, by using a link that opens a message to us), you are choosing to send us your email address and message. We will use that information to respond and to contact you about the topic of your message, such as launch and pricing for a plan you asked about. You can ask us to remove you at any time by emailing the contact address above. We handle these messages as described in the Privacy Statement. We do not sell your information. Any commercial email we send will identify us, include our postal address, and offer a way to opt out, consistent with applicable law.

12. Disclaimers of warranty

To the fullest extent permitted by law, the Service and all information, tools, and content in it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

Without limiting the above, we do not warrant that the Service will be uninterrupted, secure, error free, or available at any particular time; that any information, estimate, date, amount, or eligibility statement is accurate, current, or complete; or that using the Service will result in any scholarship, grant, aid, admission, cost, or other outcome.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Silk Creative Labs LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of goodwill, loss of scholarships, aid, admission, or opportunity, or any lost savings or profits, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars ($50).

Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Silk Creative Labs LLC and its members, managers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or third-party right, or anything you submit to a college, scholarship, program, or third-party tool.

15. Children's privacy

The Service does not require or request personal information, does not use accounts, and stores plan information only on the user's own device. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Purchases may be made only by adults. If you believe a child under 13 has provided personal information to us (for example, by emailing us), contact us at the address above and we will delete it. See the Privacy Statement for more.

16. Termination

You may stop using the Service at any time and may delete your on-device information at any time. We may suspend or terminate your access to all or part of the Service, or deactivate a license obtained or used in violation of these Terms, at any time, with or without notice, including if we reasonably believe you have violated these Terms. Sections that by their nature should survive termination (including Sections 9, 12, 13, 14, and 18) will survive.

17. Changes to the Service and to these Terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms. When we do, we will change the "Last updated" date and, for material changes, take reasonable steps to notify users, such as posting a notice in the Service. Changes are effective when posted unless stated otherwise. Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Service.

18. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree that the state and federal courts located in Sacramento County, California will have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there.
